BETWEEN: Traveling JetSetter LLC, Traveling JetSetter, ("Agency," "we," "our," or "us")
AND: You ("you," "your," "Traveler"), including all individuals listed on the same Booking.
Each may be referred to individually as a "Party" and collectively as the "Parties."
These Terms become effective upon your written, electronic, or digital acceptance, including but not limited to providing payment authorization to Agency. These Terms remain in effect until completion of your Trip unless terminated earlier in writing by either Party.
Agency reserves the right to revise these Terms at any time without prior notice. The current version is available at https://www.travelingjetsetter.com and governs all Bookings.
1. DEFINITIONS
"Booking" refers to any reservation, arrangement, or confirmation made by Agency on your behalf.
"Supplier" means any independent third party that provides Travel Services, including airlines, cruise lines, hotels, tour operators, transportation providers, guides, and activity operators.
"Traveler" includes you and every individual traveling under the same Booking, including minors.
"Travel Services" include air, land, and sea transportation; accommodations; tours; activities; excursions; entertainment; food and beverage services; and other travel-related services.
"Trip" refers to the collective Travel Services booked by Agency for you.
"Trip Plan" means the itinerary, inclusions, exclusions, pricing, and payment schedule provided by Agency.
"Trip Planning Investment" means the client service and planning fee.
1. TRAVELER RESPONSIBILITIES
You agree to carefully review these Terms, your Trip Plan, Supplier documentation, and all communications from Agency. You are responsible for providing accurate information, responding promptly to requests, approving your Trip Plan in writing, and making all payments by stated deadlines.
You agree to plan sufficiently in advance to ensure availability and avoid increased costs or late-booking penalties. You are responsible for monitoring travel advisories, entry requirements, and health regulations applicable to your Trip.
You represent that you are at least 18 years of age and authorized to accept these Terms on behalf of all Travelers included in your Booking.
2. SUPPLIERS
Suppliers are independent contractors and are not employees, agents, representatives, or affiliates of Agency. Agency does not control Supplier operations and is not responsible for Supplier acts, omissions, financial stability, or failure to perform.
All Travel Services are subject to the terms and conditions of the applicable Supplier.
Suppliers operate under their own terms, conditions, which are separate from these
Terms. By making payment, you agree to be bound by Supplier terms.
Supplier bankruptcy, cessation of operations, or service failure does not obligate Agency to provide refunds.
3. TRAVEL RISK, SAFETY & INSURANCE
Travel to certain destinations may involve greater risks than travel to others. You acknowledge that conditions related to health, safety, political stability, weather, transportation, and local infrastructure can change rapidly and without notice. Traveling JetSetter strongly encourages all clients to remain informed before and during travel by monitoring current news, government-issued advisories, warnings, restrictions, and entry requirements applicable to their destination.
Information regarding safety, security, health conditions, and travel risks may be obtained from United States government resources, including but not limited to the U.S. Department of State, Transportation Security Administration, Department of Transportation, Federal Aviation Administration, Centers for Disease Control and Prevention, and U.S. Customs and Border Protection. Enrollment in the U.S. Department of State’s Smart Traveler Enrollment Program (STEP) is strongly recommended for U.S. citizens traveling abroad to facilitate assistance in the event of an emergency.
By offering travel services to particular destinations, Traveling JetSetter does not represent or warrant that travel to such locations is advisable or free from risk. You voluntarily assume all risks associated with travel to your chosen destination(s), including the risk of illness, injury, loss, damage, delay, or death. Participation in travel arranged by Traveling JetSetter constitutes acceptance of these risks, and Traveling JetSetter shall not be liable for any resulting costs, damages, or losses.
Certain itineraries may include activities that involve inherent risks, including physical exertion, travel in remote or undeveloped areas, limited access to medical care, variable weather conditions, wildlife encounters, and participation in adventure or recreational activities. You acknowledge that such activities may aggravate pre-existing medical conditions, injuries, or congenital defects. You are solely responsible for determining your physical and medical fitness to participate and for consulting a qualified medical professional prior to booking if you have any concerns.
You agree to comply with all safety instructions, guidelines, and requirements provided by suppliers, guides, or activity operators, including the use of recommended or required safety equipment. Failure to follow safety protocols may result in denial of participation without refund.
If you consume alcohol or illegal substances before or during participation in any activity associated with your itinerary, you knowingly and voluntarily assume all risks arising from such use, including personal injury, death, property damage, or loss. You further agree to indemnify and hold harmless Traveling JetSetter from any claims, liabilities, damages, or expenses arising from your conduct while under the influence of alcohol or illegal substances, including harm to third parties, regardless of any alleged negligence by Traveling JetSetter or third parties.
In the event of emergent health, safety, security, or operational concerns, Traveling JetSetter, after reviewing the prevailing circumstances, reserves the sole and absolute discretion to proceed with, modify, substitute, suspend, or cancel any escorted trip, private departure, or itinerary component. Such decisions shall be made in the interest of client safety and operational feasibility and shall not constitute a breach of this Agreement.
Traveling JetSetter offers clients access to third-party travel insurance options designed to help protect both travelers and their financial investment. Unless expressly stated otherwise, travel insurance is not included in the cost of your itinerary. Coverage may include, but is not limited to, protection for supplier default or bankruptcy, trip cancellation or interruption, travel delays, missed cruise connections, medical emergencies, emergency evacuation and repatriation, baggage loss or delay, illness or injury, accidental death or disability, employment-related cancellations, and changes in travel plans.
Travel insurance can help mitigate financial loss in many unforeseen circumstances. Without appropriate travel insurance, you understand and agree that if your trip is cancelled, delayed, or interrupted for any reason, some or all trip costs may be non-refundable. In such cases, cancellation penalties imposed by Traveling JetSetter and third-party suppliers may apply, and you may forfeit monies paid, up to and including the full cost of your travel arrangements.
The purchase of travel insurance is not required to purchase any other product or service offered by Traveling JetSetter . However, if you decline coverage, Traveling JetSetter may require you to execute a written insurance waiver acknowledging the risks associated with traveling without insurance.
Traveling JetSetter is not a licensed insurance broker, and its advisors are not authorized to provide advice regarding insurance benefits, exclusions, limitations, or policy terms, nor to assess the adequacy of your existing insurance coverage. An additional charge applies to any travel insurance policy selected. You are solely responsible for reviewing the terms of any insurance policy purchased, understanding what is covered and excluded, and securing additional or alternative coverage if desired.
Traveling JetSetter makes no representations or guarantees regarding the approval of any insurance claim or the scope of coverage provided under any insurance policy offered or quoted. All claims decisions are made solely by the insurance provider in accordance with the policy terms.
This clause will survive termination of these Terms.
4. PERSONAL INFORMATION
You authorize Agency to collect, use, and share your personal information with Suppliers and third-party service providers as necessary to arrange your Trip. Agency is not responsible for third-party data handling or security breaches beyond its control.
5. PRICING & INCLUSIONS
Prices are based solely on the inclusions outlined in your Trip Plan. Prices do not include government-imposed taxes or fees, gratuities, optional excursions, personal expenses, insurance, or items not expressly listed.
Supplier pricing and availability are subject to change until full payment is received. Additional fees may apply after payment due to fuel surcharges, currency fluctuations, or Supplier-imposed increases.
6. CREDIT & DEBIT CARDS
By providing your credit or debit card (“Card”), you confirm that you are an authorized user and that you authorize Agency, or its agents, to charge your Card for all payments according to the schedule outlined in your Trip Plan. You also authorize Agency, or its agents, to credit your Card for any amounts charged in error.
You are responsible for any costs or fees arising from: (1) providing an incorrect Card number; (2) declined charges; (3) insufficient funds on the payment dates in your Trip Plan; or (4) a Card that is closed or expired before all payments are completed.
If any of these issues occur, Agency reserves the right to suspend or cancel your Booking. In such cases, Agency is under no obligation to refund amounts already paid.
7. CHARGEBACKS
You agree not to initiate chargebacks except in cases of verified fraud. You must first submit disputes to Agency in writing and allow reasonable time for investigation. Unauthorized chargebacks may result in liability for recovery costs and legal fees.
If a chargeback, reversal, or recollection of a previously authorized payment is initiated, Traveling JetSetter reserves the right to recover any additional costs incurred as a result, including administrative fees, supplier penalties, collection costs, and reasonable attorney fees where applicable.
This clause will survive termination of these Terms.
8. PAYMENT, CHANGES, CANCELLATIONS & REFUNDS
You agree to pay all deposits and balances by the deadlines stated in your Trip Plan. Failure to do so may result in cancellation, penalties, or forfeiture of payments. Agency is not responsible for Supplier penalties resulting from late or missed payments.
All changes and cancellations are governed by Supplier policies. Agency service fees of USD 150 per Trip may apply. Refunds are not guaranteed and may be subject to Supplier timelines and conditions.
You are fully responsible for all charges associated with your travel arrangements, including but not limited to fares, service fees, supplier fees, taxes, duties, and assessments related to bookings made through Traveling JetSetter.
By submitting a credit card authorization form, you authorize Traveling JetSetter to use your approved payment method to purchase travel services from our trusted third-party suppliers on your behalf. Except in cases of proven fraud, you agree not to dispute or initiate a chargeback with your bank or credit card company as a means of avoiding or circumventing the booking terms and conditions of Traveling JetSetter or its suppliers. This includes, but is not limited to, cancellations, itinerary changes, or disruptions caused by circumstances beyond our control or the control of our suppliers.
All payments for travel services are due in accordance with each supplier’s specific terms and deadlines and must be paid in full prior to departure. Failure to make timely payments or to comply with a supplier’s conditions of purchase may result in the cancellation of your reservations, denial of travel services (including flights, hotels, tours, or cruises), and/or forfeiture of any monies already paid.
Please note that many travel bookings are non-refundable once confirmed and under deposit. In some cases, there are no refunds under any circumstances. Changes or cancellations made after confirmation may result in penalties or the loss of funds paid. All cancellation requests must be submitted to Traveling JetSetter in writing. Any applicable supplier cancellation fees will be charged to the payment method on file or deducted from any refund issued by the supplier.
If you request changes to your confirmed travel arrangements—either before departure or while traveling—Traveling JetSetter will make reasonable efforts to assist you. However, not all bookings can be modified. You are responsible for any additional costs imposed by suppliers, as well as any applicable supplier or Traveling JetSetter change fees. All change requests must be submitted in writing.
For tours, cruises, and packaged travel priced under supplier contract rates, no refunds will be issued for unused portions of travel, missed services, or early departures.
This clause will survive termination of these Terms.
9. NO SHOWS
Failure to appear for any Travel Service is considered a no-show and may result in forfeiture of all payments.
10. ACCOMMODATIONS
All hotel accommodations are subject to availability at the time of booking. Certain properties may require non-refundable and non-transferable deposits to secure your reservation. In such cases, Agency will notify you in advance regarding any required pre-payment.
Amenities, including but not limited to air conditioning, elevators, bed type or size, connecting or adjacent rooms, accessibility features, on-site restaurants, bars, fitness centers, pools, and spas, are provided at the discretion of the property and are not guaranteed to be operational or available during your stay. Any issues or disruptions related to hotel amenities are the responsibility of the hotel, and Agency is not liable for refunds, compensation, or alternative arrangements resulting from such circumstances.
11. AIR TRAVEL
Airline tickets may be non-refundable and non-transferable. Seat assignments, baggage policies, and service fees are determined by the airline. Agency is not responsible for airline operational changes, delays, or cancellations.
You understand and agree that Traveling JetSetter acts solely as a booking agent for air carriers. We do not issue airline tickets, do not hold or process client funds for airfare, and are not the Merchant of Record as defined under U.S. Department of Transportation regulations. All airline tickets are sold directly by the air carrier, and your purchase is governed by the airline’s contract of carriage and fare rules.
Because Traveling JetSetter does not hold or handle airline funds, any refunds, credits, or compensation related to cancelled or delayed flights, schedule changes, missed connections, seat assignments, baggage fees, or ancillary airline services must be requested directly from the airline. Traveling JetSetter cannot issue, guarantee, or expedite airline refunds or credits.
Airline schedules, aircraft, routing, and seat assignments are subject to change at any time. Traveling JetSetter assumes no responsibility for air schedule changes, delays, cancellations, or operational decisions made by the airline. Failure to use any portion of an airline reservation may result in the automatic cancellation of remaining segments, including return or continuing flights, and may result in the forfeiture of airfare in accordance with airline fare rules.
In some destinations, departure taxes may be assessed at the airport and, in rare cases, may be payable in cash only. These fees are the sole responsibility of the traveler and may vary without notice.
Airline e-tickets generally expire one (1) year from the date of issue unless otherwise specified by the airline’s fare rules. You are responsible for reviewing all airline fare restrictions and ticket conditions prior to travel.
Due to enhanced security procedures, it is strongly recommended that you check in no less than two (2) hours prior to scheduled departure for domestic flights and three (3) hours prior to scheduled departure for international flights. You are also responsible for reconfirming flight times directly with the airline at least twenty-four (24) hours prior to domestic departures and seventy-two (72) hours prior to international departures.
12. TRAVELER CONDUCT & RESPONSIBILITY
You are fully responsible for any damage, loss, or harm caused by your actions, omissions, or negligence, and for covering the full cost of such damage or loss directly with the affected Supplier or third party.
Agency is not responsible for any costs, claims, or consequences arising from Traveler conduct, including removal or denial of access to any Travel Service due to behavior that is negligent, willful, or otherwise. You agree not to hold Agency, its owners, directors, employees, agents, or representatives liable for any claims resulting from your actions or omissions.
An Authorized Party—including, but not limited to, any Supplier, ship operator, tour operator, guide, crew member, or group leader—may, at their sole discretion, refuse to provide, suspend, or require you to leave any Travel Service or transportation if they reasonably determine that:

For purposes of this section, Authorized Party refers to any Supplier or individual providing Travel Services or related goods, including owners, directors, employees, agents, or representatives of such Suppliers.
13. DISABILITIES & SPECIAL NEEDS
If you have a disability or special need that may require additional support, accommodations, or non-emergency assistance, you must notify Agency in advance of booking.
Airlines and other Suppliers may impose fees, size restrictions, or other limitations on wheelchairs, mobility devices, or medical equipment. If you cannot use your personal devices, rental options may be available, potentially at additional cost. Travelers with service or emotional support animals must coordinate in advance with Suppliers, providing any required documentation regarding the animal’s health, training, or other relevant factors.
Travel outside the United States and Canada may be subject to different laws, regulations, standards, and accommodations for persons with disabilities or special needs. Certain destinations may have limited medical facilities, restricted access to prescription medications, or limited means to accommodate specific requirements. You should consult your healthcare provider prior to booking to ensure you can safely travel.
Agency will make reasonable efforts to request or coordinate assistance and accommodations with Suppliers; however, we cannot guarantee that all needs or expectations will be met. Agency is not responsible for any Supplier’s inability or failure to provide requested accommodations or services.
14. FOOD ALLERGIES
If you have food allergies or related health conditions that could affect your safety during travel (“Food Allergies”), please notify Agency prior to booking.
Travelers with Food Allergies acknowledge that their condition may involve increased risk of reactions, delays, or disruptions while traveling. Each Traveler is solely responsible for managing their Food Allergies, including taking necessary precautions, reviewing ingredients, communicating needs to suppliers, and carrying any required medications or emergency supplies before, during, and after travel.
15. RISK ACTIVITIES
Certain trips may include activities that carry inherent risks, including physical exertion, outdoor or adventure experiences, or travel in remote or undeveloped areas (“Risk Activities”). By participating, you acknowledge and accept these risks, which may include injury, illness, or other unexpected events.
Travelers are solely responsible for evaluating their own fitness, skill, and medical condition before participating in any Risk Activities. You agree to follow all safety instructions, guidelines, and requirements provided by suppliers, guides, or activity operators. Failure to comply may result in denial of participation without refund.
Traveling JetSetter is not liable for any injury, illness, loss, or damage arising from participation in Risk Activities, whether caused by negligence or otherwise, and you release and hold harmless the Agency, its suppliers, and representatives in connection with such activities.
This clause will survive termination of these Terms.
16. ILLNESS & INJURY
If you become ill or injured before or during your trip, you are solely responsible for your personal health, medical care, and treatment. This includes, without limitation, all medical expenses, emergency services, accommodations, and any alternative travel arrangements that may be required as a result.
You acknowledge that Traveling JetSetter has no obligation to delay, modify, or interrupt any itinerary or travel arrangements due to your illness or injury, and you agree that your condition shall not impose obligations, delays, or burdens on other travelers. You are responsible for any costs or consequences arising from missed flights, connections, activities, or unused travel services.
You hereby release and hold harmless Traveling JetSetter, its suppliers, contractors, affiliates, and fellow travelers from any and all claims, liabilities, losses, damages, or expenses arising from or related to your illness or injury, including but not limited to missed travel, delays, or forfeited bookings.
17. BAGGAGE & PERSONAL ITEMS
Agency is not responsible for loss, theft, damage, or delay of baggage or personal belongings.
18. PASSPORTS, VISAS & DOCUMENTATION
You are responsible for obtaining and maintaining all required travel documents. No refunds will be issued for failure to comply.
Once your travel documents are issued, it is your responsibility to review them carefully and confirm that all details are accurate, including names, dates, destinations, and travel times. If any corrections or changes are needed, you must notify Traveling JetSetter immediately.
If Traveling JetSetter is not notified of required corrections within twenty-four (24) hours of your receipt of the travel documents, we cannot be held responsible for any additional costs, fees, or penalties incurred to make those corrections at a later time.
19. INDIVIDUAL ENTRY AND EXIT REQUIREMENTS
Each country maintains its own entry and exit requirements and determines admissibility based on its laws, which may include how past or current criminal offenses are evaluated, whether those offenses occurred domestically or abroad. Requirements and enforcement vary by destination and are subject to change without notice.
If you have a current or prior criminal offense, it is your responsibility to contact the appropriate embassy or consulate of the destination country directly to confirm your eligibility to enter and exit. Traveling JetSetter does not have the authority to determine admissibility or guarantee entry into any country.

20. IMMUNIZATIONS AND HEALTH REQUIREMENTS
You are solely responsible for obtaining all required and recommended immunizations, health screenings, medications, and related documentation necessary for travel. Entry, transit, and re-entry health requirements vary by destination and may change at any time without notice.
Traveling JetSetter does not warrant or assume responsibility for the accuracy, completeness, or timeliness of health, vaccination, medical, or documentation requirements, either prior to departure or upon arrival at any destination. In certain countries, proof of vaccination may be required and must be properly recorded by a licensed healthcare provider on an official vaccination certificate, which you are responsible for carrying during travel.
If you have concerns about medications, vaccinations, or health conditions that may affect your travel, you must consult with your healthcare provider prior to booking. Failure to comply with applicable health requirements may result in denied boarding, refusal of entry, quarantine, or other travel disruptions, for which Traveling JetSetter bears no responsibility.
For general information, you may consult the U.S. Department of State and the Centers for Disease Control and Prevention (CDC) travel resources. However, final responsibility for compliance with all health and medical requirements rests solely with you.
21. PANDEMICS, EPIDEMICS, AND TRAVEL ADVISORIES
You are solely responsible for remaining informed of, and complying with, all governmental regulations, restrictions, and advisories related to pandemics, epidemics, public health events, and other travel-related safety measures. This responsibility applies before booking, prior to departure, during travel, and upon return.
You acknowledge and warrant that you have reviewed, understand, and will continue to monitor guidance issued by the U.S. Centers for Disease Control and Prevention (CDC) and the U.S. Department of State, including all notices, warnings, entry requirements, testing mandates, vaccination requirements, quarantine rules, and travel restrictions applicable to your itinerary. Government policies and requirements may change at any time and without notice.
You understand that destination countries, transit points, airlines, cruise lines, and border authorities—including the United States—may require testing, vaccination verification, health screenings, isolation, or quarantine upon entry, transit, or re-entry to your country of residence. You further acknowledge that access to required testing or documentation may be limited or unavailable at certain destinations, which may impact your ability to travel or return as planned.
Additional screening procedures or public health restrictions may be implemented in airports, hotels, cruise ships, trains, tours, and other public or private venues, including but not limited to temperature checks, face coverings, health declarations, or denial of services. Failure to comply with applicable requirements or to provide required documentation may result in denied boarding, refused entry, mandatory quarantine, travel delays, or inability to return to your home country, for which Traveling JetSetter assumes no responsibility.
22. RESTRICTED PRODUCTS AND MATERIALS
You are solely responsible for understanding and complying with all applicable laws, regulations, and restrictions in each country or jurisdiction in which you travel or transit.
This includes, but is not limited to, the possession, transport, or use of:
Possession or use of restricted items or Drugs may result in immediate termination of travel services, and you may be subject to investigation, detainment, prosecution, fines, or incarceration by local authorities. You are responsible for carrying all required documentation, including valid prescriptions from a licensed medical provider, where applicable.
Traveling JetSetter assumes no liability for violations of local laws, penalties, or legal consequences resulting from your possession, transport, or use of restricted or illegal products or materials.
23. GROUP TRAVEL TERMS
For all group travel arrangements, a designated Group Leader is required. The Group Leader serves as the sole point of contact between Agency and all group participants.
The Group Leader is responsible for distributing information, collecting required details, communicating deadlines, and ensuring compliance with payment schedules and documentation requirements. Agency is not responsible for miscommunication between the Group Leader and group participants.
Individual group participants are bound by these Terms and Supplier terms. Group pricing, amenities, and space are subject to minimum participation requirements and Supplier rules. Failure to meet minimums may result in repricing or cancellation.
Group deposits are typically non-refundable and non-transferable and are based on each individual Supplier's own terms and conditions. Name changes, substitutions, or cancellations may be restricted or prohibited, or may have a service fee associated with each by Supplier.
Agency is not responsible for interpersonal disputes, group dynamics, or participant conduct within the group.
24. GROUP LEADER ACKNOWLEDGEMENT & RESPONSIBILITIES AGREEMENT
This Group Leader Acknowledgement ("Agreement") is entered into between Traveling JetSetter ("Agency") and the undersigned Group Leader ("Group Leader"). This Agreement applies to any group trip organized, promoted, or coordinated by Agency.
By signing this Agreement, Group Leader acknowledges and agrees to the following:

25. GROUP TRAVEL PHOTOGRAPHY & MARKETING CONSENT
This Photography & Marketing Consent ("Consent") applies to all group trips organized or arranged by Traveling JetSetter ("Agency").
By participating in a group trip, each Traveler acknowledges and agrees to the following:
26. LIMITATION OF LIABILITY
Traveling JetSetter acts solely as a travel booking agent. All travel services, including but not limited to tours, accommodations, transportation, excursions, and activities (“Travel Services”), are provided and controlled by third-party suppliers who are independent of Traveling JetSetter . We have no control over, and are not responsible for, the acts, omissions, performance, safety, or operations of any supplier, their employees, representatives, facilities, equipment, or services. Suppliers alone are responsible and liable for the Travel Services they provide.
Traveling JetSetter makes no representations or warranties, express or implied, regarding the quality, suitability, safety, availability, or value of any Travel Services. We are not liable for any claims, losses, damages, or expenses arising from the acts or omissions of any supplier, traveler, or third party, whether negligent, willful, or otherwise. This includes, without limitation:
Traveling JetSetter shall not be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages, even if advised of the possibility of such damages. To the fullest extent permitted by law, any liability awarded against Traveling JetSetter shall be limited to the total commissions received by us for the travel services purchased by you through our agency.
This limitation applies regardless of the cause of action or legal theory, including contract, tort, negligence, or strict liability, and survives termination of these Terms. All other warranties or representations, whether express or implied by law, statute, or otherwise, are hereby excluded.
This clause will survive termination of these Terms.
27. INDEMNIFICATION
You, on behalf of yourself and all adult and minor travelers included in your booking who reside in your household (each, an “Indemnifying Party”), agree to indemnify, defend, and hold harmless Traveling JetSetter, its owners, directors, employees, contractors, agents, representatives, advisors, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorney’s fees and legal costs, arising out of or related to:
This indemnification obligation shall survive the completion, expiration, or termination of these Terms.
28. FORCE MAJEURE
No failure or delay by Traveling JetSetter in performing any obligation under these Terms shall constitute a breach if such failure or delay is caused by events or circumstances beyond our reasonable and foreseeable control (“Force Majeure”). Force Majeure events include, but are not limited to: acts of God; natural disasters such as floods, storms, or fires; explosions or accidents; war or threats of war (declared or undeclared); terrorism, sabotage, insurrection, riots, or civil unrest; strikes or labor disputes; pandemics, epidemics, or quarantines; and government actions, regulations, or interventions.
Traveling JetSetter shall not be liable for any loss, damage, or additional costs resulting from a Force Majeure event and will not provide refunds for travel services affected by such events. If a supplier providing your Travel Services is impacted by a Force Majeure event, the supplier may, at its sole discretion, modify, postpone, or cancel any portion of your itinerary or travel arrangements without notice. In such cases, you remain responsible for arranging and covering the cost of any alternative travel or accommodations.
The purchase of comprehensive travel insurance is strongly recommended for all trips to protect against losses resulting from Force Majeure events, including cancellations, delays, medical emergencies, and trip interruptions.
29. GENERAL
Amendments. These Terms may be amended only in writing by Agency.
Assignment. You may not assign any right or obligation under these Terms without
Agency’s prior written consent, which will not be unreasonably withheld or delayed.
No forbearance or delay in enforcing these Terms will prejudice or restrict any
rights of you or Agency. No waiver of a right will operate as a waiver of any subsequent
right. No right is exclusive of any other right, and each right is cumulative.
Severability. If any part of these Terms is found unenforceable, that part will be enforced
to the fullest extent permitted by law and the remainder of these Terms will remain fully in
force.
Relationship of Parties. These Terms do not create an agent relationship, partnership, joint
venture, or employment relationship between or among the Parties. You have no authority
to bind Agency or incur any obligation on Agency’s behalf.
Discretion. While each Party acknowledges its duty of good faith and fair dealing, a Party’s
discretion means it may consider its own interests without considering the effect of its
decision on the other Party.
Notices. Notices under these Terms will be in writing and deemed given when sent receipt
confirmed to the receiving Party’s email or other address provided under these Terms for
purposes of notice.
Acceptance. You may confirm acceptance of these Terms in writing, digitally, or
electronically, including by clickwrap, sign-in-wrap, or other active or passive electronic
confirmation. Any counterparts created will constitute a single original document.
Conflicts. If any conflict arises between Supplier terms and these Terms or travel
documents prepared by Agency, the Supplier terms will control. If any conflict arises
between these Terms and travel documents prepared by Agency, the latter will control.
Interpretation. The Parties intend that: (1) headings will not be used to interpret these
Terms; (2) the words “include” and “including” are without limitation; (3) no text will be
construed against either Party as author; and (4) all text is conspicuous.
Termination. Upon termination of these Terms, each Party’s rights and obligations will
cease immediately, but termination will not affect: (1) either Party’s rights and obligations
accrued but unsatisfied at termination; or (2) any provision of these Terms expressed to
survive termination or by a reasonable reading of its context will survive its termination.
Governing Law. These Terms are governed exclusively by the laws of Missouri without
regard to conflict-of-law principles of any jurisdiction.
Dispute Resolution. If any dispute arises under these Terms, the Parties will use all
reasonable efforts to resolve the dispute informally through direct communication.
If the Parties are unable to resolve a dispute through informal discussions within
60 days of notice of dispute, any claim arising from these Terms will be resolved
exclusively by the state or federal courts located in Missouri County, Missouri, which
neither Party will challenge based on forum non conveniens or similar doctrine.
Equitable Relief: Either Party may seek injunctive or other equitable relief to remedy any
actual or threatened breach of these Terms.
30. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Missouri. Disputes shall be resolved in Missouri courts after good-faith efforts at informal resolution.
31. AGENCY DISCLOSURE
Traveling JetSetter is an independent travel agency authorized to operate under WorldVia Travel Network.
